Is the Immigration Order Constitutional? - Trump v. International Refugee Assistance Project

On October 10, the U.S. Supreme Court will hear oral arguments in Trump v. International Refugee Assistance Project, which challenges the President’s Executive Order temporarily suspending entry from six countries. Is this order constitutional under the authority delegated to the President by Congress? Is the issue even justiciable or outside the authority of the federal courts? Did the lower courts show adequate deference to the President with respect to this national security issue or does the executive order violate the Establishment Clause? The Heritage Foundation is hosting an event to preview the arguments that will be made before the Court by two leading experts on constitutional law and executive authority.
